WORK PERFORMANCE CONDITIONS
The following general conditions apply to all technical services, ship repairs and maintenance work carried out by B M T. Please read them carefully before confirming your order.
01.- The above rates apply to a 12-hour workday or part of it, being the work carried out during normal working hours. The customer will be charged a minimum of 8 hours per day for each day the engineer is away from our facility. Hours worked per day shall not exceed 12. In exceptional cases this period may be extended up to 16 hours, but with a maximum of 24 hours of work for two days. A 16-hour work period must always be followed by a rest period of at least 10 hours. In general, there must always be a minimum of 8 hours off between two consecutive workdays. After 6 consecutive workdays there should always be an uninterrupted full day off.
02.- Any additional material/spare parts required for this work, will be quoted, and invoiced separately.
03.- Any modification of a.m. conditions will have to be agreed in writing. Verbal modifications do not have any validity.
04.- Once the order is confirmed in writing, in case of cancellation of the order, any material purchased by B M T necessary for carrying out the requested works will be fully invoiced to the client.
05.- Flights, accommodation, and travel expenses, if required, will be invoiced as per cost +10%.
06.- Time required for travelling to/from the job site is considered worked time and will be charged at our standard hourly rates. As per current legislation, if travel time is more than 12 total hours, it requires a minimum of 8 hours resting time before the team can report to site.
07.- Allowances: An amount of 95,00 Eur/labour/day will be charged for each day the team is away from facilities. This amount applies for jobs executed in Spain. If due to exceptional circumstances the real cost of accommodation and meals in Spanish territory exceeds the amount indicated above, it will be invoiced at real cost + 10%. Expenses outside Spain will always be charged at real cost + 10%. If the team is at a location where no daily living expenses are incurred and amenities are provided by the customer (platform, ship, isolated camp etc) the allowance expense will not apply for the days in which no living expenses are incurred.
08.- The working area must be clean and operational.
09.- Any delay due to alien cause of B M T will be invoiced.
10.- Port taxes for repair activities are not included. They are normally charged in the final invoice with original vouchers from the corresponding port, as +2,5% for Algeciras Port, +4% for Valencia & Sagunto Port and no additional charges for Barcelona Port.
11.- Payment conditions: within 30 days from works completion, unless otherwise agreed.
In case of late payment, the interest on late payment shall be applied in accordance with Law 3/2004, accruing automatically without the need for a formal demand; furthermore, both parties expressly agree that the customer shall bear all costs incurred by BMT in recovering any owed amount.
12.- B M T guarantees good performance of all repairs assigned to our company, but in no circumstances will B M T be responsible for any other damage that can cause loss of profit (off hire clause) that might be alleged or claimed by the client.
Off hire: BMT shall not be liable under any circumstances for indirect damages, and the client waives any claim against BMT in this regard, including loss of profit and off hire.
13.- This quotation has a validity of 30 days.
14.- Final report, if required, will be invoiced as per two (2) normal working hours.
15.- Team availability will be confirmed upon reception of official PO.
16.- Relevant material and personnel certification, ISO 9001, 14001 & 45001 certification, WPS / WPQR for floor or IRATA welders (where required), will be presented to the client after reception of official PO.
17.- Work permits to be applied to port authorities minimum 24hrs in advance, during working days (Monday to Friday) from 09:00 to 14:00hrs as per Algeciras & Valencia Port regulations. Barcelona port requires applications to be presented 48hrs in advance.
18.- Site and working area: If repairs and operations take place at a quay, the client expressly acknowledges that BMT is not a shipyard, and that the mooring conditions, access conditions and the structural condition of the quays are beyond BMT’s control. Furthermore, all fees and costs arising from its use shall be the responsibility of the client. The client guarantees that the site is operational and that the work area is clean, accessible, and safe.
19.- Warranty. Any warranty provided by BMT is limited to a period of 6 months, and applies solely to labour carried out by BMT, and does not extend to parts/materials supplied by third parties or provided by the shipowner. Any implied or statutory warranty beyond that agreed is excluded. Warranties for parts and machinery shall be those provided by the manufacturer or supplier, to whom the customer must address their claims directly.
20.- Notification and inspection. If, following the provision of a service by BMT, the customer identifies any fault or defect, they may not have it repaired by a third party without first informing BMT and allowing BMT to inspect it.
